ARCA activates the withholding of Income Tax on the export of precious metals – Trade News | 16/01/26

The Agency for Tax Collection and Customs Control (ARCA) issued General Resolution 5815/2026, establishing a withholding regime for Income Tax specifically on exports of precious metals without transfer of title —such as “doré” gold or concentrates shipped abroad for refining, analysis, or custody—. Under this regime, Customs will act as the withholding agent at the time of shipment, requiring an advance payment of the tax, directly affecting companies’ cash flow as a fiscal pre-payment. The measure aims to close a tax avoidance gap by taxing the merchandise at export regardless of ownership change and is part of strengthened fiscal and customs controls over foreign exchange-earning sectors, although mechanisms for refunds or credits if the final sale does not occur are yet to be defined. Link to Article
